Public Offer (Terms of Sale) TinDay

This document is a public offer to enter into a remote sale-purchase agreement for goods through the website tinday.com.ua (hereinafter — the "Site"). By placing an order on the Site and/or making a payment, the Buyer confirms that they have read and accept the terms of this Offer.

  1. Definitions

    • Seller — the business entity selling goods through the Site.
    • Buyer — an individual placing an order on the Site.
    • Product — clothing/accessories and other goods presented on the Site.
    • Order — a request placed by the Buyer to purchase a Product through the Site/TinDay messengers.

  3. How the agreement is concluded

    1. The agreement is considered concluded after the Seller confirms the order (by email, a messenger message, or another method used by TinDay), and/or after the goods are actually shipped. The procedure for concluding electronic agreements is governed by the Law of Ukraine "On Electronic Commerce."
    2. The Seller may clarify order details (size, color, address details, delivery/payment method).

  4. Prices, availability, product descriptions

    1. Prices on the Site are listed in Ukrainian hryvnia (UAH), unless otherwise stated.
    2. For international payments via PayPal, payment may be in the currency of the Buyer's PayPal account/bank. Conversion is performed by the payment service or bank (at their rate/terms).
    3. We do our best to ensure photos and descriptions are accurate. However, color shade may vary depending on screen settings and lighting.
    4. In case of an obvious technical error (price/description/availability), the Seller has the right to clarify the information and agree with the Buyer on further actions (confirmation at the correct price or cancellation of the order).

  5. Payment

    Available payment methods:

    • LiqPay (card payment, as well as Apple Pay / Google Pay via LiqPay);
    • Cash on delivery at Nova Poshta branches (subject to the carrier's rules, fees may apply);
    • Payment to sole proprietor's bank details (bank transfer);
    • PayPal for international orders (in the currency of PayPal/bank).

  6. Delivery

    1. Ukraine: Nova Poshta / Ukrposhta.
    2. Worldwide: Nova Poshta / Ukrposhta and other carriers (by agreement).
    3. TinDay's shipping time: usually 1–3 business days, unless otherwise stated on the product page or in the order confirmation.
    4. Pre-orders / made-to-order items: shipping times for such items may differ — they are stated on the product page and/or agreed separately.
    5. Free delivery within Ukraine applies to orders over 3000 UAH (terms may depend on the delivery method and promotion rules — current terms are stated on the "Delivery and Payment" page).
    6. International delivery is paid by the Buyer. Customs fees/taxes in the recipient's country (if any) are also paid by the recipient.

  7. Exchange, return, refunds

    1. Exchange/return terms are set out on the "Return and Exchange" page and are part of this Offer.
    2. In accordance with Ukrainian law, a consumer has the right to exchange a product of proper quality within 14 days (not counting the day of purchase/receipt — depending on registration practice), provided the product's commercial condition is preserved, etc.
    3. Custom orders / customer-specific alterations (for example, changes to garment length, sleeve length, etc.) are not subject to return/exchange, except in cases of manufacturing defects or an error on the Seller's part.
    4. Items sold at a discount due to documented defects: if a defect was explicitly indicated/shown at the time of sale and the buyer agreed to a "no return" condition, these terms apply to the specific promotion/item (stated in the product description/order).
    5. Refunds: money is refunded using the same payment method. As a general rule — on the day the agreement is terminated, and if that's not possible — no later than 7 days (by agreement of the parties).

  8. Quality, defects, fulfillment errors

    1. Please check the product upon receipt. If you receive a defective, damaged, or incorrect item, contact us as soon as possible via info@tinday.com.ua or 097 337 38 25, and add photos/video — we will offer a solution (exchange/replacement/return).

  9. Personal data

    Personal data processing is carried out in accordance with TinDay's Privacy Policy, published on the Site. By placing an order, the Buyer consents to the processing of personal data to the extent necessary to fulfill the order and provide support.

  10. Intellectual property rights

    All materials on the Site (photos, texts, design, logos) are objects of intellectual property rights. Their use without TinDay's permission is prohibited.

  11. Force majeure

    The parties are released from liability for failure to fulfill obligations due to circumstances of force majeure (military actions, communication/logistics disruptions, transportation bans, etc.), for the duration of such circumstances.

  12. Changes to the terms

    TinDay may update this Offer. The current version is always available on the Site. Continued use of the Site after changes means acceptance of the updated terms.

  13. Applicable law and disputes

    This Offer is governed by the laws of Ukraine. In the event of disputes, the parties shall attempt to resolve them through negotiation; if this is not possible — in the manner prescribed by the laws of Ukraine.
